USER (CLIENT) AGREEMENT
ANYWAYANYDAY BOOKING SYSTEM

The given document is an official proposal to the User to make an Agreement on the terms listed below. The Agreement is placed on the website www.anywayanyday.com on the Internet and is duly provided to the User to be familiarized with before making a booking and payment. According to the article 435 of the Civil Code of the Russian Federation, the present document is an offer.

By activating any section of ANYWAYANYDAY booking system the User expresses his acceptance of the offers given in the section. The User’s activation of the “User Agreement” on anywayanyday website equals to his offer acceptance, i.e. the User’s final acceptance of all the terms and conditions of the present Agreement and to the parties’ signing of the Agreement.

TERMS OF USE

All the infrastructure of anywayanyday, its software and the information provided on the website is the property of ANYWAYANYDAY LIMITED, Stasandrou, 8, 3rd Floor, Flat/Office 301, P.C. 1060, Nicosia, Cyprus. Furthermore, ANYWAYANYDAY LIMITED is the owner of the following duly registered rights protected by the applicable law: the exclusive right to use anywayanyday and AVANTIX domain names and trademarks. All trademarks, registered names, logos and other attributes of copyright law displayed on anywayanyday website in any form are considered to be a duly protected property of their owners. The owners and the partners of anywayanyday authorize the Users to download, print and use the information provided on the website exclusively for personal noncommercial purposes. All quoting of or references to the website or its information and all the actions in conflict with the aims and purposes of anywayanyday creation as well as the commercial use of the website and its contents are permitted only with written consent ofANYWAYANYDAY LIMITED .

By activating the “User Agreement”, the Customer agrees not to modify, copy, publish, derive or spread the information taken from anywayanyday. The User also agrees not to use any computer software for information collection to access or copy any information or data provided on anywayanyday and to use no software which may damage anywayanyday website or interfere with its proper functioning.

GENERAL PROVISIONS

Section “Hotels” of anywayanyday website has been created for an easier introduction of the offers provided by the hotels and for online hotel reservation and purchase of the related services by the Users.

The services in the country of temporary residence are rendered to customers by service providers. The contribution to the User service booking is made by RUS e-Tickets SA (Switzerland) and “Bukbilet” Ltd. (Russia), hereinafter referred to as the Agent.

All accommodation agreements provided on anywayanyday shall be entered into by the User with providers of such services either directly or (depending on the cooperation conditions with service providers) indirectly. The User is informed that the cooperation conditions of the service providers situated on the territory of foreign states are subject to the law of foreign states and can differ from the conditions applied on the territory of the Russian Federation (as well as in terms of reservation cancellation policy and agreement termination). The final conditions of the trip cancellation, including the fee charged, are specified in the reservation confirmation.

This Agreement shall be deemed to be concluded upon the User’s confirmation of the consent to its terms and conditions by ticking a box at the reservation page. After that this Agreement shall be deemed to be the basic document with regard to formal relationships between the User and anywayanyday booking system. Making a payment the User additionally confirms his consent with the terms and conditions of the Agreement as well as his receipt of necessary and reliable information. By conclusion of this Agreement, the User confirms to be of sui juris, have full legal capacity and be aware of the responsibility for the obligations in respect of this Agreement and the use of anywayanyday booking system. The User confirms the responsibility and shall be held liable for inaccurate, incomplete and unreliable information of persons for whom the reservation is made.

Accepting the terms of this Agreement, the User undertakes to use anywayanyday booking system only when really needed to book a hotel or any related services. Shall the User fail to observe the terms of this Agreement, the User’s access to anywayanyday booking system may be blocked and subsequently restricted.

OBLIGATIONS AND LIABILITIES OF THE PARTIES

By using anywayanyday website and its booking system, the User undertakes to submit only true and accurate personal information. Otherwise, the Agent takes no responsibility for the results of booking and service payment.

The User guarantees to bring the terms and conditions of the given Agreement to the notice of all the persons using the services booked by the User. The persons using the services jointly with the User shall not be considered the party of the Agreement and shall lay no claims to the Agent.

The User and the persons in behalf of which the User makes a contract express their consent on processing personal data such as surname, name, middle name, date and place of birth, sex, citizenship and nationality; passport serial number and number, persons named in the passport, other passport details; address and registration, home and mobile phone numbers, e-mail address; marital, social, property status (including data on real estate, car ownership); occupation; information (including address, work phone number, job position, work period) about current and previous places of employment; about state of health, any other data provided by the User while making or performing a contract.

Personal data processing is conducted by the Agent and (or) service providers for the purpose of performing a contract (as well as for the purpose of room booking) and includes personal data acquisition, systematization, accumulation, storage, refining (updating, change), use, distribution, depersonalization, locking, destruction.

The given written consent on personal data transmission is valid for an uncertain term. The consent validity ceases based on a written statement which is signed by the User and handed to or sent as a registered letter with a return receipt to the Agent and service providers.

The rights of the personal data subject are explained to the User. Since the booking system is a dynamic system which components can be modified or updated at any time, the User is advised to use the booking system “as is”. The Agent bears no responsibility for full or partial temporary break down of the system and its components or failure of the User to access the system or any direct or indirect expenses incurred by the User in relation with these circumstances.

Unless a reservation is completed and the User receives confirmation, all offers, prices and sales conditions provided on anywayanyday are subject to:

Modifications without the User’s notice;
Limitations in relation to time, room availability and dates of the advance reservation, trip dates, terms of minimum and maximum stay at the place of destination, days off and holidays, seasonal price fluctuations, waiting lists as well as strikes and temporary break down of the booking system and/or subject to other variations, conditions and restrictions.

All descriptions of hotels and rooms, rooms availability, rates, regulations and other conditions of the offered services to be rendered are provided on anywayanyday in full conformity with the information made available by booking systems of direct service providers or their authorized representatives. Despite its competence and thorough choice of service providers the Agent is unable to carry out total independent verification of the information offered by service providers and cannot guarantee its full accuracy. Accordingly, the Agent bears no responsibility for any incorrect information in relation to services as well as for any damages or losses caused to or incurred by the User resulting from any errors in the information.

The Agent shall not be held responsible for any violations of booking conditions and regulations by service providers as these conditions and regulations are exclusively in their competence.

The Agent shall be under no liability to the User for the quality and protection of transmission channels used by him on anywayanyday website and for any damage resulting from his use of unprotected transmission channels or channels of poor quality.

In case of the User’s check-out before the end of the stay period, the money is refunded according to the rules of the service providers and at their discretion. The Agent and the service providers have a right to refund the money but are not obliged to do it.

The Agent shall bear no responsibility for the negative consequences and damages incurred by the User due to the events and circumstances outside his competence and also for the third parties’ acts (failure to act), i.e.:

for the acts of service providers and means of accommodation;

for the acts of carriers (modification, cancellation, change of timetable for bus and other transport means);

for no-show of the User or other persons at the hotel to be checked in;

for any acts of authorities including consular services and border control authorities;

for validity and proper condition of the User’s and other persons’ documents;

for the discrepancy of the accommodation conditions to the User’s subjective estimate.

The Agent shall bear no responsibility for unilateral acts of hotel administration, carriers, guides, other accompanying persons.

MODIFICATIONS

The Agent reserves the right to change terms and conditions of anywayanyday website and the booking system use at any time and to amend terms and conditions of the present Agreement prior to the User’s acceptance of such terms and conditions (activation of the “User Agreement”). New terms and conditions shall become valid since they are placed on the website ANYWAYANYDAY, unless the time of their coming into force is otherwise specially agreed.

BOOKING ORDER

A person intended to use and/or consequently used a hotel service booked on anywayanyday website assumes responsibility for the preparation of the documents needed for the trip. These persons are recommended to familiarize and comply with all requirements of the Country they are intended to arrive in or depart from regarding the preparation of documents required for entry and departure, accommodation, visas, passports validity, powers of attorney or other documents needed for entry/departure of children, etc. The Agent shall be not responsible for Passengers’ unawareness or non-fulfillment of such requirements and not obliged to provide the User with the information about entry rules to the country of temporary residence.

A reservation made by the User shall be final. Both for instant confirmation offers and after the hotel confirmation receipt for offers on demand the voucher is issued at once. In some cases the vouchers are issued within 24 hours upon the reservation is made (excluding weekends and holidays). An accommodation voucher is issued automatically after the User provides his credit card details to make an instant payment or to ensure the amount is enough for payment of any fines subject to Hotel regulations in case of the User’s no-show. If the User wants to cancel the reservation, he should go to his personal account on www.anywayanyday.com and confirm the cancellation of the selected reservation. The customer may be charged a cancellation fee subject to the cancellation or non-arrival policy of the Agent, provider or hotel. If the User wants to amend personal data of the persons to be accommodated in a hotel (one or more guests’ surnames) as well as period of stay, room type and the hotel itself, he needs to cancel the order and then make a new one. In exceptional cases in order to amend some information about the persons to be accommodated in a hotel, the User can contact the Agent customer support centre which contact details are specified on the accommodation voucher and provide the reservation number and new data on the guests. This service is as a rule available free of charge but in some cases the Agent can charge an extra fee for rendering of services on amending the reservation. The Agent can also reject to amend the reservation. In this case the User needs to cancel the order and make a new one.

The User’s partial or overdue payment as well as his non-fulfillment of other terms and conditions of the Agreement can be regarded as the frustration of the Agreement due to the User’s fault and can imply the refusal to refund.

In case certain Hotels offer cheaper rates for a definite period of stay, the User shall be informed of the fact that the rates offered may be subject to special restrictions and regulations concerning, e.g. cancellation and refund regulations. The User is recommended to find out more about the hotel regulations in respect to the offered rates prior to booking.

In certain cases the hotel is entitled to block the amount to be paid for one night - full stay prior to check-in. It is done to check the validity of the User’s credit card and to prevent losses which may be incurred by the hotel in case of the customer’s non-arrival or late cancellation of the reservation. In case anywayanyday provides services on hotel booking which should be paid for while making an order, the Agent blocks and/or charges the total order amount when the payment is made by credit card.

Making a reservation at the hotel, the User accepts all terms and conditions, cancellation and non-arrival policies and all additional conditions and regulations (hotel services) including services and/or products offered at the hotel (hotel regulations and terms are available at the corresponding hotel). Making a reservation through the Agent, the User accepts all terms and conditions, cancellation and non-arrival policies and all additional conditions and regulations (hotel services) of the Agent or another provider of hotel accommodation services. General cancellation policy and actions to be done in case of non-arrival are available to the Users while booking a hotel on anywayanyday hotel choice page and in the electronic confirmation of the reservation.

The Agent is entitled to set a mark-up on the services offered by the service providers as a payment for contribution to the User in accommodation booking.

On the search results page there are check-in time and date displayed for each hotel. In case of a later check-in the hotel may give a refusal and cancel the booking.

All modifications of electronic vouchers, refusal to accept services and other conditions of services to be rendered by their providers are subject to the regulations of the hotel or the provider of such services and this Agreement.

To view, change or cancel the reservation, the User should refer to the electronic confirmation of the reservation (voucher) and follow the instructions specified therein. The User can be charged a cancellation fee if subject to the Hotel regulations, the Agent or a provider.

In some cases to secure a reservation, the hotel requires credit card details. All credit card details will be forwarded directly to the hotel chosen by the User. The standard industrial technology “Secure Sockets Layer” (SSL) is used for data coding and protection. The Agent cannot be held responsible for any actions of the Hotel in connection with the received data.

The Agent confirms that anywayanyday website has been created on the basis of the most up-to-date technologies to provide optimum security level for commercial transactions made with credit cards and undertakes not to store the Users’ credit card information. When the User works with anywayanyday website, his personal information and his credit card details are reliably protected. The digital system of anywayanyday has successfully undergone the strictest security tests and is consequently certificated. Information security is confirmed by SSL 128 bit certificate issued by Thawte. Anywayanyday operates in full conformity with Visa and MasterCard security standards (PCI compliance). Anywayanyday security is confirmed by HackerSafe certificate issued by McAfee.

LINKED WEBSITES

Anywayanydaywebsite may contain links to other websites which are provided solely as a convenience to the User. Placement of such links on anywayanyday website shall not be considered as a recommendation or a requirement to visit them with any legal effect. The mentioned websites work autonomously and are bound with no obligations with anywayanyday and its owners. Hence, none of anywayanyday or its owners shall be responsible for contents of such websites, quality of goods and services provided by them and consequence of their use.

CURRENCY CONVERTER

The person making a booking with anywayanyday will see the accommodation price shown in RUR, CHF, EUR, USD and UAH, the four latter convertible in RUR at the Central Bank of Russia rate as of the date of payment.

The final price reported to the User when booking with us will be published in the currency of the hotel or service provider and in RUR.

The sum total shown on www.anywayanyday.com in RUR shall be valid only if fully paid in cash in Russia at the time of booking.

In case payments are made using bank cards, the estimated amount is written off the User’s card in currency of the hotel, service provider or the Agent. The card-issuing bank converts the specified amount into the card currency at its own rate, this allowing for possible variation between the actually debited amount and the one specified on www.anywayanyday.com (either way), since private bank exchange rates always differ from those published by the Central Bank of Russia and FOREX.

Before making any payments the User must check the exact card-issuing bank rate and the conversion fee. When making a payment the User confirms being duly and well in advance informed and aware of the final price in his/her card currency.

Currency rates specified in the booking system and on anywayanyday website may differ from current rates on the currency markets at the moment of booking. Currency converter information is updated from time to time and may not coincide with current rates on the currency market due to their constant fluctuations. The information provided by the currency converter on anywayanyday website is deemed to be correct, but when the order is made, the accuracy of such information cannot be guaranteed.
